What Is a Settlement Agreement?

A settlement agreement is a legally binding contract between an employer and employee. It usually sets out the terms of ending employment, including:

  • The amount of any settlement or redundancy payment.

  • Waiver of the employee’s rights to bring claims in the employment tribunal.

  • Any confidentiality, non-compete, or non-disparagement clauses.

  • References or other post-employment arrangements.

For the agreement to be valid, the employee must receive independent legal advice from a qualified solicitor.
